Hearing on writ against CJ Rana's acquittal by Parliament Secretariat concludes

The hearing on the writ filed against the acquittal of suspended Chief Justice Cholendra Sumsher Rana has concluded in the Supreme Court today. 

A constitutional bench comprising Acting Chief Justice Hari Krishna Karki, Bishwambhar Prasad Shrestha, Ishwar Prasad Khatiwada, Anand Mohan Bhattarai and Anil Kumar Sinha heard arguments on the writ.

A constitutional bench was formed to hear the writ filed against CJ Rana and Federal Parliament Secretariat (FPS) General Secretary Bharat Raj Gautam, who gave a clean sheet to Rana, stating that the impeachment against him had turned ineffective.

Following the completion of the hearing, an order in the case is expected later in the day.

Supreme Cour Bar Association President Senior Advocate Purnaman Shakya and others had filed a writ against Rana's aquittal by the FPS General Secretary Gautam.

An interim order has been sought in the writ to stay the implementation of Gautam's letter as it renders Rana's impeachment ineffective, allegedly by violating the jurisdiction of FPS general secretary.

It is claimed in the writ that since General Secretary Gautam unduly restricted and interefered with the jurisdiction of the House, his action of giving clean sheet to CJ Rana is illegal.

CJ Rana had been suspended since February 13 after lawmakers of the ruling alliance filed a motion of impeachment against him. Since Rana's impeachment motion could not be finalized by the House as its term ended, it was said that the new House would take up the motion and finalize the impeachment.

But the FPS issued a letter stating that the impeachment against CJ Rana had turned ineffective, arguing that the next parliament could not accept the impeachment motion.
