Chairman of Rastriya Prajatantra Party (RSP) Ravi Lamichhane is set to take an oath of office and secrecy in the House of Representatives (HoR).
Supreme Court on Wednesday paved the way for Lamichhane to take the oath as a member of the parliament (MP) by refusing to issue an interim order on the writ petition filed by Yuba Raj Paudel.
On November 22, Petitioner Paudel lodged the writ petition seeking revocation of his membership of the parliament as well as the chairmanship of the RSP arguing that Lamichhane is not a Nepali citizen legally.
Lamichhane had been elected as a lawmaker from Chitwan 2 in the general election on November 20. Paudel had filed a writ in the Supreme Court against Lamichhane stating that his citizen is illegal.
A Constitutional Bench led by Acting Chief Justice Hari Krishna Karki, Justices Ishwar Khatiwada, Ananda Mohan Bhattarai, Anil Kumar Sinha and Prakash Man Singh Raut refused to issue the order.
The Constitutional Bench of the Supreme Court has decided to summon both the petitioner and defendant for discussions. The court will decide on the matter following the discussions.
Eldest lawmaker Pashupati Shamsher Rana will administer oath of office and secrecy to the newly elected lawmakers on Thursday.
