The Supreme Court of Nepal has refused to issue a stay order on the writ petition filed by Nepali Congress seeking reinstatement of the dissolved House of Representatives (HoR).
A constitutional bench of the Supreme Court declined to issue an interim order on Wednesday, regarding the writ filed by NC lawmakers including Chief Whip Shyam Kumar Ghimire. It issued a show cause order, instead.
The writ had been filed at the court arguing that the dissolution of the HoR violated the provision of the Constitution of Nepal.
The constitutional bench comprising Chief Justice Prakash Man Singh Raut, Justices, Sapana Pradhan Malla, Kumar Regmi, Manoj Kumar Sharma and Dr Nahakul Subedi, inquired the defendant to furnish the reason why the interim order be issued against the HoR dissolution.
The Office of the President, Prime Minister Sushila Karki, the Election Commission, the Office of the Prime Minister and the Council of Ministers and Speaker have been made the defendants in the writ.
Eight lawmakers including Chief Whip had lodged the writ at the apex court on December 9, seeking the scrapping the of the government's decision to dissolve the House and an interim order to form a new government as per the Constitution of Nepal.
Then Prime Minister KP Sharma Oli had stepped down following the Gen Z movement on September 8 and 9. President Ram Chandra Paudel formed an interim government under the premiership of Sushila Karki with the mandate to hold elections on March 5.
