The hearing on dispute on citizenship identity card of Deputy Prime Minister and Minister for Home Affairs Rabi Lamichhane is underway in the Constitutional bench of Supreme Court today.
The advocates for and against Home Minister Lamichhane are delivering their arguments on the writ petition against Lamichhane.
Arguing on the writ petition on behalf of the petitioner Yubaraj Paudel, advocate Surendra Bhandari claimed that Lamichhane is not a Nepali citizen. “How can we call Lamichhane a Nepali citizen when he arrived in Nepal on an American passport and visa? he argued.
Acting Chief Justice Hari Krishna Karki, Justices Ishwor Prasad Khatiwada, Dr Aananda Mohan Bhattari, Anil Kumar Singha and Prakashman Singh Rau are hearing on the writ.
The Constitutional bench on December 21, 2022 held a hearing on this case and decided that discussion between the two sides will be held today on whether to issue interim order or not.
Debate is being held today whether to issue interim order or not. Advocates Rabiraj Basaula and Yubaraj Poudel among others had filed a writ petition raising question on the qualification of the Deputy Prime Minister Lamichhane's election to House of Representatives member who is also chairperson of Rastriya Swatantra Party.
The writ petition demanded scrapping parliamentarian post of Deputy PM Lamichhane stating that Lamichhane ran a political party without obtaining Nepali citizenship and got elected to HoR without competing in the election.
