Supreme Court (SC) of Nepal has issued an order to release Secretary at the Ministry of Communication and Information Technology Krishna Bahadur Raut.
Hearing the writ petition on Friday, a joint bench of Justices Prakash Kumar Dhungana and Nahakul Subedi issued the order to release Raut on the condition that he would not be allowed to go abroad.
On July 12, Secretary Raut had filed a writ of habeas corpus in the Supreme Court. On July 13, a single bench of Justice Til Prasad Shrestha issued a show cause notice ordering him to appear before the Supreme Court within 24 hours.
The hearing gained momentum after the writ was scheduled for hearing in the joint bench of Justices Prakash Kumar Dhungana and Nahakul Subedi on July 17.
Even though the apex court ordered the release of Raut, it required the other defendants to be kept in the judicial custody for further investigation.
Three including Min Bahadur Gurung, the owner of Bhatbhateni Supermarket, former Election Commissioner Sudhir Kumar Shah and former employee at land revenue office Dharma Prasad Gautam had also filed a writ of habeas corpus at the court.
However, their writ has been dismissed, with an order to keep them in the custody for further investigation.
