A writ petition filed against the formation of the Koshi Province is being heard by a full bench of the Supreme Court today (Monday).
A full bench comprising Justices Sapana Malla, Kumar Chudal and Nahakul Subedi will hear the writ petition.
CPN (UML) Parliamentary Party leader Hikmat Karki on August 23 filed the writ at the Supreme Court arguing that the vote of confidence taken by Chief Minister Uddhav Thapa on August 21 was constitutional.
Concluding that the issue of the writ is serious, Justices Malla and Mathema on Sunday decided to send it to the full bench.
“A complex legal questions has cropped up in the writ as the previous writ (072-WO-1494) of the similar kind had been heard by the full bench earlier,” said the Supreme Court, “Hence, this writ should also be settled through the full bench in line with the Rule 23 (2 C) of the Supreme Court Regulations, 2074.”
Smail Mansur, who chaired the province assembly, had cast his vote when Chief Minister Thapa took the vote of confidence on August 21.
Chief Minister Thapa, Province Chief Parshu Ram Khapung and the Province Secretariat have been mentioned as defendants in the writ.
