30-year service limit to remain in effect for Nepal Police

The Supreme Court of Nepal has maintained the 30-year service limit, revoking the interim order issued earlier by Justice Hari Prasad Phuyal.

With this Supreme Court’s verdict, as many as 89 police officials including Deputy Inspector General of the Police (DIG) Bishnu Kumar KC are set to retire.

Hearing the vacate petition filed by the government, a joint bench of Justices Binod Sharma and Sharanga Subedi issued the verdict in favor of the original retirement policy, overruling the interim order issued by the apex court on Thursday.

Even though their 30-year service limit will take effect starting Sunday, their service limit expires today, since tomorrow is a Saturday (holiday).

Police officials retire when the earliest of three criteria is met: age limit, service limit, or medical reasons. The 89 officials are retiring upon completion of 30 years of service.

Verdict issued unilaterally after hearing boycott
The advocates who turned up in the court for advocacy on behalf of twenty-one petitioners SSP Jivan Kumar Shrestha have boycotted the bench questioning over its hearing proves.

Despite the boycott, a joint bench of Justices Binod Sharma and Sharanga Subedi took the hearing process and issued the verdict.

Similarly, an advocate pleaded on behalf of DIG Bishnu Kumar KC arguing that his seniority should be based on his original date of joining the Nepal Police, rather than the date he appeared for the Police Inspector exam. KC had received the letter of retirement effective from September 1.

Senior Advocates Hari Uprety, Tikaram Bhattarai, and Sushil Panta had questioned the bench's procedures and hearing process since the very beginning.

The bench heard the combined petitions filed by DIG Bishnu Kumar KC and 21 police officers, including SSP Jivan Kumar Shrestha, as well as the government's appeal to vacate the writ petitions.

89 police officials retire
With the revocation of last week's interim order, the employment period of 89 police officials has come to an end.

Upon completion of 30 years of service, those retiring en-masse include officials including DIG Bishnu Kumar KC, who joined the Nepal Police as a Police Inspector in 2051 BS, to Police Inspectors.

Eleven senior Superintendents of Police (SSPs) are retiring. They include traffic police chief SSP Jivan Kumar Shrestha, Rewati Dhakal, Kisan Singh Thapa, Dilli Raj Bista, Bel Bahadur Pandey, Nabin Raj Rai, Ravi Kumar Paudel, Bir Bahadur Oli, Chandradev Rai and Rabindra Regmi.

Among the SPs, Krishna Prasain, Prem Bahadur Basnet, Rajendra Babu Regmi, Lakshmi Raj Adhikari, Devendra Bahadur Pal, Bishnu Hari Koirala, Awadesh Bista Chhetri, Narendra Kumar Karki, Tekunanda Iwa Limbu, Chitra Bahadur Gurung and Nabin Kishor Pradhan have also retired.

Similarly, the DSPs retiring today include Shriram Bhandari, Bharat Kumar Shah, Ram Krishna Sapkota, Ganesh Bahadur Shrestha, Bharat Bahadur Chaudhary, Ain Bahadur Malla, Kiran Prasad Neupane, Hom Bahadur Thapa, Manoj Kumar Shrestha, Janak Bahadur Malla, Rajan Kumar Gautam, Mahesh Basnet, Khagendra Prasad Rijal, Bhoj Raj Pandey, Lal Bahadur Bam.

Similarly, Narayan Bahadur Shrestha, Rakesh Kumar Podar, Govinda Panthi, Dalram Tamata, Madan Bahadur Kunwar, Dev Bahadur Kunwar, Hikmat Bahadur Bohara, Anil Kumar Uprety, Shailendra Kumar Khadka, Uddhav Prasad Adhikari, Ram Bahadur Chand, Sujit Kumar Ojha, Phanindra Ranabhat, Bijaya Thapa, Jamuna Kumari Basnet are also retiring.

Likewise, 35 inspectors have retired. Among those retiring are Yograj Neupane, Shanta Ram Karki, Hira Bahadur KC, Khem Raj Kadayat, Saroj Kumar Thakurathi, Jayaram Onta, Bhuwan Bhatta, Krishna Rana Magar, Om Prakash Wagle, Bijulinath Yogi, Gindra Bahadur Bogati, Khim Bahadur Ghartimagar, Arjun Prasad Pokharel, Udayaman Dwivedi, Kashiraj Regmi, Hari Bishnu Dhakal, Ravi Bhushan Prasad Yadav, Rajendra Prasad Yadav, Uday Singh Sijapati, Mohan Thapa, Kalendra Bikram Shahi and Man Prasad Shrestha.

Similarly, Kisan Chand Thakuri, Awadhkishore Ojha, Vijay Bhandari, Bhim Bahadur Karki, Prem Bahadur Bohra, Narpati Bhatt, Jagat Damai, Meghnath Chapagain, Nilam Bahadur Bhandari, Tirtha Bahadur Bhandari, Jagdish Poudel, Gopal Chalise and Kamal Acharya have also retired.
