Kulman and Hitendra's writ under review as hearing remains inconclusive

The writ petitions filed by Kulman Ghising and newly appointed Managing Director Hitendra Dev Shakya—challenging their removal from the position of Managing Director of the Nepal Electricity Authority—have been held for review after today’s hearing remained inconclusive.

The Supreme Court administration has informed that the next hearing on the writs will be held on Wednesday.

The Supreme Court is currently hearing the writ petitions filed by Ghising and newly appointed Managing Director Shakya, who were removed from the position of Managing Director of Nepal Electricity Authority.

The hearing was held in the bench of Justices Kumar Chudal and Nityanand Pandey today, this afternoon. The hearing focused on the writ petition of Ghising and Shakya, putting aside all other petitions scheduled for today.

However, the hearing on the writs were kept under review since the hearing remained incomplete.

Earlier, the writ petitions were scheduled to be heard in the joint bench of Chief Justice Prakash Man Singh Raut and Justice Saranga Subedi on Sunday. However, the petition was rescheduled for today after the bench recused it citing the conflict of interest.

Kulman, in the writ, has demanded an interim order on the government's decision, arguing that the government has removed him from office with malicious intent.

Shakya, on the other hand, has claimed that Kulman cannot hold office as his initial appointment was illegal. He, in the writ, has also argued that Kulman's current petition cannot be heard without finalizing the writ he filed four years ago.
