The Supreme Court (SC) has asked for an explanatory note regarding the order to remand Rabi Lamichhane, president of the Rastriya Swatantra Party (RSP), in custody for further investigation.
The bench of Supreme Court Justice Tek Prasad Dhungana made this request for an explanatory note, along with the basis for the decision to send him to custody, after completing the preliminary hearing on Sunday.
The Tulsipur High Court (Butwal bench) had issued an order on April 4 to send Lamichhane to custody. Against this order, an appeal was filed on behalf of Lamichhane, an accused in the Supreme Cooperative scam, which was registered in the Supreme Court on Friday.
Lamichhane was arrested on April 4 from his home in Budhanilkantha, Kathmandu following the High Court's order. He was flown to Butwal on April 5 and was sent to prison in accordance with a court's detention order.
Earlier, on January 26, Judge Prahlad Kumar Yogi of Rupandehi District Court, had ordered Rabi's release on a bail of Rs 10 million. In the same case, another accused, Chhabilal Banjade, was sent to custody for further investigation.
In the Supreme Cooperative case, 42 others including Rabi, Chhabi, and GB Rai, have been named as defendants. They are accused of embezzling over Rs. 550 million from the cooperative.
Among them, Rabi, Chhabi, and GB Rai are accused of illegally operating Rs 109 million and 936 thousand through the establishment of Gorkha Media Pvt. Ltd. GB Rai is currently at large.
