The Supreme Court has scrapped the writ petition filed demanding the cancellation of the 1947 Tripartite Treaty on the Gurkha Recruitment.
A joint bench of Justices Ananda Mohan Bhattarai and Sushma Lata Mathema on Tuesday issued a verdict scrapping the writ petition.
On June 9, 2017, former British Gurkha Association filed a writ at the apex court against the Gurkha Treatment Treaty.
Even though the writ filed by Padam Sundar Limbu and Uttam Rai on behalf of the Association was quashed, the apex court has issued a mandamus in the name of the government.
The apex court has issued a mandamus in the name of the government to review the tripartite treaty between Nepal, the United Kingdom, and India on recruitment.
A tripartite treaty between Nepal, India, and the UK had been signed in 1947 to recruit Nepali youth in India, and British Gurkha regiments.
The Association had filed a petition demanding the cancellation of the petition saying that the treaty is discriminatory, unequal, and not in the interest of the Nepali people.
The Nepali youth are being used as mercenaries against the allies making a mockery of the national independence and self-respect of a sovereign country, the Association has said in the petition.
