A Constitutional Council (CC) meeting held at the Office of the Prime Minister and the Council of Ministers on Monday evening decided to recommend acting Chief Justice Hari Krishna Karki as the Chief Justice.
The Chairman of the National Assembly, Ganesh Prasad Timilsina, informed that there was a unanimous decision to recommend acting Chief Justice Karki as the Chief Justice.
Although the CC meeting decided to recommend Karki as the Chief Justice, a parliamentary hearing special committee (PHSC) is yet to be formed for the hearing.
The CC includes Prime Minister Pushpa Kamal Dahal 'Prachanda', main opposition party leader and UML chairman KP Sharma Oli, Speaker of the House of Representatives Devraj Ghimire, National Assembly Chairman Ganesh Timilsina, Minister of Law, Justice and Parliamentary Affairs Dhanraj Gurung and Deputy Speaker of the House of Representatives Indira Rana. Chief Justice also remains a member of the CC.
However, acting Chief Justice Hari Krishna Karki did not participate in the CC meeting where he had to recommend himself.
Article 284 of the Constitution has laid down a provision for the formation of the Constitutional Council.
According to the provision, the Law Minister will participate as a member of the Constitutional Council only in the meeting summoned to recommend the Chief Justice.
The recommendation for the new appointment has to be made one month before the post lies vacant, according to the constitutional provision.
