High Court Patan has issued an order forcing the Ministry of Foreign Affairs to immediately renew the membership of the Non-Resident Nepali Association (NRNA).
A bench of Judges Hari Prasad Paudel and Krishna Ram Koirala issued this mandamus to the Foreign Ministry on Wednesday.
Court Information Officer Tirtharaj Bhattarai informed Nepalkhabar that the mandamus was issued as per the request of the petitioner.
With this court's decision, the government's attempt to deactivate the organization has fallen flat.
The Ministry of Foreign Affairs has withheld the renewal file of NRNA, an organization of Nepalis from 86 countries across the globe, which has a history of two decades, for the past six months without any reason.
President Dr Badri KC on December 27 filed a writ in the High Court stating that the Foreign Ministry withheld the renewal of the organization despite fulfilling due procedures
Section 16 of the Non-Resident Nepali Act, 2008, and Rule 12 of the Non-Resident Nepali Rules, 2009 lays down a provision to renew the organization every 10 years by paying a fee of Rs 5,000.
Conducting a preliminary hearing on the petition, a bench of Judge Narayan Prasad Regmi on December 28 issued a show cause order to the Ministry of Foreign Affairs for withholding the renewal file.
