A contempt of court case has been filed against Prime Minister KP Sharma Oli, seeking his dismissal, alleging that he obstructed the implementation of the Supreme Court's mandamus by bringing an ordinance related to land.
Advocate Om Prakash Aryal on Monday moved the apex court by mentioning Prime Minister Oli and Minister for Land Management Balaram Adhikari as defendants in the petition.
The Supreme Court administration registered the petition today and scheduled the hearing for February 16.
Advocate Aryal in the petition has argued that Prime Minister has constantly obstructed the implementation of the court's mandamus issued by the constitutional bench on February 7, 2024.
The Supreme Court, in granting the exemption, also mandated the immediate and compulsory acquisition of any land exceeding the allowed limit. This acquisition, in the name of the Nepal government, was to be carried out under the Land Act, 2021.
Specifically, the mandamus targeted land that was either being used for purposes other than those specified in the exemption conditions, or was being left vacant and unused.
In addition, the Supreme Court's mandamus also mentioned that the land in Jhapa, which was in the name of Giribandhu Tea State Pvt. Ltd., which was found to be in excess of the limit and was not being used for tea industry work, should be acquired in the name of the Nepal government in accordance with the Land Act, 2021.
Petitioner Aryal claims that a recently brought ordinance is the latest attempt by the Prime Minister and the Land Management Minister to obstruct the implementation of a mandamus, a duty they are responsible for.
