Nepal Electricity Authority (NEA) Managing Director Kulman Ghising has vehemently stated that the Ministry of Energy, Water Resources and Irrigation has no right to seek clarification or take action against him.
Managing Director Ghising said so in his response to the clarification sought by the ministry on Thursday.
"I was appointed for a four-year term on August 9, 2021, as per the decision of the Council of Ministers and in accordance with Section 17 (1) of the Nepal Electricity Authority Act 2041," he stated in the clarification to the ministry, "I reiterate that the ministry does not have the authority to seek clarification or take action regarding the removal of the petitioner from service, according to Section 16 of the Law Interpretation Act 2010."
Ghising stated in his clarification letter that the ministry has not provided any basis for the request for clarification, terming the ministry's accusation baseless, fabricated and driven by ill-intent.
"My performance evaluation report clearly demonstrates a comprehensive overview of the progress I've made since my appointment," Kulman responded, "Hence, demanding further clarification based on a subjective dissatisfaction with the response is contrary to the established principles of law and justice," reads the response submitted by Kulman.
He also objected to being denied a proper and sufficient time to defend himself.
Kulman asserted that seeking clarification with a 24-hour deadline now, after taking no action for a month and a half regarding the clarification submitted on January 12, is procedurally flawed, unauthorized, and driven by prejudice.
