The Supreme Court of Nepal is set to hear a high-stakes petition today regarding the legitimacy of the Nepali Congress leadership. The case challenges the Election Commission's decision to recognize the Central Working Committee elected through a recent Special General Convention.
The bench, comprising Justices Sharanga Subedi and Nripadhwaj Niraula, will deliberate on the writ filed by the faction led by Sher Bahadur Deuba. Previously, on April 10, a bench of Acting Chief Justice Sapana Pradhan Malla and Justice Meghraj Pokharel ordered that notice be served to the opposing party, including General Secretary Gagan Thapa, who was elected as President by the special convention.
This legal battle began when the Election Commission validated the new leadership, prompting Deuba and Purna Bahadur Khadka to move the apex court. While the court earlier refused to issue an interim order to halt the new committee's functions, it granted "priority status" to the case, citing the need to resolve significant legal questions.
