Kulman’s writ goes unheard as bench recuses over conflict of interest

The writ petition filed by Kulman Ghising, former Managing Director of the Nepal Electricity Authority, challenging his dismissal, has been postponed as the bench recuses over a conflict of interet. 

A joint bench of Chief Justice Prakash Man Singh Raut and Justice Saranga Subedi were scheduled to hear the writ petition filed by Ghising today.

The joint bench declined to hear the writ on the ground that Advocate Radheshyam Adhikari, who was scheduled to plead on behalf of the defendant, had served as a partner at the Chief Justice Raut's law firm.

Newly elected NEA Managing Director Shakya's writ is also set to be heard by the same bench. The apex court had sought written responses from both the defendants.

Kulman had moved the Supreme Court after he was removed from the post as the Managing Director of the NEA. He was removed four months before the expiry of his tenure.

Similarly, newly elected Managing Director Shakya has filed a writ seeking the court's verdict on it prior to that of Kulman's.
