The Supreme Court has issued a stay order on the construction of Pathivara Devi Dharshan Cable Car Pvt. Ltd.
Hearing on the writ filed by petitioner Yam Bahadur Limbu on behalf of the No Cable Group, a single bench of Justice Saranga Subedi issued the stay order on the construction of the Pathivara Cable Car in Taplejung district.
Senior advocates Kedar Prasad Dahal, Narayan Prasad Devkota, Padam Bahadur Shrestha and advocates Dil Raj Khanal, Som Sapkota, Prem Chandra Rai, Jitendra Bahadur Madai had pleaded on the writ petition on behalf of petitioner Limbu on March 24.
The apex court has summoned both the petitioners and defendants for discussions on April 8.
The court will decide on the interim order after hearing on the arguments from both the sides, reads the order issued by the court.
Pathivara Cable Car construction has mired in disputes after pro-identity groups opposed it demanding an immediate halt to it.
They have demanded a halt arguing that its construction will spoil the sacredness of Pathibhara (Mukkumlung) as well as social, cultural and religious beliefs held by thousands of devotees, especially indigenous Yakthung descendants.
On the other, Chandra Dhakal, the major investor of Pathivara Cable Car Construction Project, is hell-bent on moving the project forward, despite protests and demonstrations staged by the agitating groups.
There have been frequent clashes between the security personnel and the Mukkumlung protectors, resulting in injuries to both the sides, over the cable car construction.
The temple is located 19.4 kilometers north-east of Phungling Municipality which is populated heavily by the Yakthung descendants.
