The Supreme Court of Nepal has refused to issue an interim order as sought by Kulman Ghising, paving the way for the newly appointed Managing Director of the Nepal Electricity Authority, Hitendra Dev Shakya, to carry out his duties.
A joint bench of Justices of the Supreme Court, Kumar Chudal and Nityananda Pandey refused to issue the interim order after hearing on the writ petitions filed by Kulman and Hitendra Dev for three days.
With the ruling, the newly elected Managing Director Hitendra Dev will carry on with his daily duties as usual until the final verdict on the writ is issued.
Kulman had filed a writ petition seeking a stay order on the government's decision arguing that he was removed from the post of the Managing Director of the Nepal Electricity Authority with an ill-intent four months before the expiry of his term.
The government on March 24 had removed Kulman as the Managing Director of the NEA and appointed Hitendra Dev in his place.
On the other hand, Hitendra had submitted a writ arguing that Kulman's case should not be resolved without first finalizing his pending writ filed four years ago.
Following the pleading on the writs by the government attorneys and some advocates on behalf of Hitendra Dev, Kulman's advocates had presented their counter-pleadings.
