Scrap HoR dissolution, appoint largest party leader as PM: NC to SC

Nepali Congress has argued that the President, who was constitutionally obliged to appoint the leader of the largest parliamentary party following the resignation of the then Prime Minister KP Sharma Oli, failed to do so.

A writ petition filed at the Supreme Court (SC) on Sunday by Shrawan Kumar Shrestha on behalf of Shyam Kumar Ghimire, the then chief whip of Nepali Congress in the dissolved House of Representatives, whip Sushila Thing, and several other lawmakers, argues that appointing an individual who was not a Member of Parliament as prime minister was unconstitutional.

The petition also demands that the decision to dissolve the House of Representatives be overturned and that the situation be restored to the status quo as of September 9, 2025.

Citing Article 76 (1) of the Constitution, the writ states that the President must appoint as prime minister the leader of the parliamentary party with a majority in the House. It adds that under Article 76 (2), if no party holds a clear majority, only a member of the House who secures majority support from two or more parties represented in Parliament can be appointed prime minister.

The petition further argues that if a government cannot be formed under these two provisions, Article 76 (3) allows only the leader of the parliamentary party with the highest number of members in the House—who must also be a Member of Parliament—to be appointed prime minister.

“This is not a discretionary power of the President,” the writ states, stressing that the constitutional provisions are mandatory. It furthers states that even under Article 76 (5), only a member of the House who can command a majority may be appointed prime minister."

गैर संवैधानिक तवरले प्रतिनिधिसभाको सदस्य नभएको, कुनै राजनैतिक दलको संसदीय दलले समर्थन नगरेको, धारा ७६ तथा धारा १३२ (२) विपरित नियुक्त भएका प्रधानमन्त्री सुशीला कार्कीको नियुक्ति प्रथम दृष्टिमै असंवैधानिक भएको हुँदा निजको प्रधानमन्त्री पदमा भएको नियुक्ति विरुद्ध अधिकार पृच्छाको आदेश जारी गरी पाउँ। 

प्रधानमन्त्री पदमा सुशिला कार्कीलाई नियुक्ति गर्ने सम्माननीय राष्ट्रपतिज्युको मिति २०८२ भदौ २७ को निर्णय, सोको आधारमा भएको प्रधानमन्त्रीज्युको सपथ ग्रहण तथा अन्य नियुक्ति समेत उत्प्रेषणको आदेशले बदर गरी पाउँ। साथै विपक्षी प्रधानमन्त्री नियुक्त भएपश्चात विपक्षीहरुबाट भए गरेका मन्त्रीपरिषद्को विस्तार लगायतका गैरकानूनी एवम् असंवैधानीक सम्पूर्ण कार्यहरु बदर गरी पाउँ। 

प्रधानमन्त्री सुशीला कार्कीको एकल सिफारिसमा सम्माननीय राष्ट्रपतिबाट मिति २०८२ भदौ २७ गते गरिएको प्रतिनिधिसभा विघटनको निर्णय उत्प्रेषणको आदेशले बदर गरी २०८२ भाद्र २४ गते गतेकै स्थिति कायम हुने गरी परमादेशको जारी गरी पाउँ। 

तत्कालीन प्रधानमन्त्री केपी शर्मा ओलीले आफ्नो पदबाट राजीनामा दिई सकेको अवस्थामा नयाँ सरकार गठनको लागि संविधानको धारा ७६ बमोजिमको प्रकृया प्रारम्भ गर्नु भनी राष्ट्रपतिको नाममा परमादेश जारी गरी पाउँ। 

असंवैधानिक तवरले नियुक्त प्रधानमन्त्री श्री सुशिला कार्की र निज नेतृत्वको सरकारले गर्ने भनिएको प्रतिनिधिसभाको निर्वाचन समेत अवैधानिक नै हुने हुँदा प्रतिनिधिसभा विघटन पश्चात प्रतिनिधि सभाको निर्वाचनसंग सम्वन्धित सम्पूर्ण काम कारबाही प्रतिषेधको आदेश जारी गरी रोकी पाउँ। मुलुकलाई संसदविहिनताको स्थितिबाट मुक्त गरी अवरुद्ध संवैधानिक प्रक्रियामा रक्त संचार गरिपाऊँ।
