A bench consisting of Justices Binod Sharma and Abdul Aziz Musalman is scheduled to hear the writ petition filed against the decision to drop the case against Rastriya Swatantra Party (RSP) President Rabi Lamichhane.
Attorney General Sabita Bhandari Baral had decided to withdraw the charges of organized crime and money laundering leveled against him.
Yubaraj Safal, Senior Advocate Dinesh Tripathi and Advocate Abhas Regmi have filed a writ petition demanding the cancellation of the decision.
Earlier, the hearing was held for four days from last Sunday to Thursday. After a four-day hearing, the bench of Justices Sharanga Subedi and Sunil Pokharel ordered the submission of the Attorney General's latest decision, dated January 16, including other related files.
In the cases of Surya Darshan of Kaski, Supreme of Rupandehi, Swarna Lakshmi of Kathmandu, and Sano Paila Cooperative of Parsa, Lamichhane has been made a defendant for fraud, money laundering, and organized crime.
Earlier, Lamichhane had filed a petition with the Attorney General's Office requesting the withdrawal of the money laundering and organized crime charges against him. Bhandari had decided to approve the amendment of the charges as per Lamichhane's demand.
In the meantime, Lamichhane has been elected as a member of the House of Representatives from Chitwan 3. He was released after paying the amount he owed before the election.
After his release upon paying 27.484 million rupees, Rabi is seeking to have the remaining two charges dropped by refunding the depositors' money.
Lamichhane was released after paying a bail of 6.5 million rupees in Suryadarshan Cooperatives, 6 million rupees in Swarna Lakshmi, 10 million rupees in Supreme Cooperative, 5.4 million rupees in Sahara Cooperatives, Chitwan and 10 million rupees in Sano Paila Cooperative.
