The Supreme Court of is hearing on the writ petition filed against the long-term power trade agreement reached recently with India today (Tuesday).
Nepal Bar Association and Supreme Court Bar Association have sent two advocates -- Kedar Karki and Semanta Dahal as amici curiae -- to assist the Supreme Court on the writ petition.
The Supreme Court bench will hear the advices of the amicus curiae before taking a final call on the writ petition, sources have said.
The apex court earlier requested amicus curiae from the two legal associations to discuss the interim order on the long-term electricity trade agreement with India.
Hearing on the writ filed by Suryanath Upadhyaya, the former secretary of the Government of Nepal, on January 30, a single bench of Supreme Court Justice Nahakul Subedi issued a show cause notice to the government about the recently signed power trade deal with India, questioning whether the agreement requires to be endorsed by two-thirds majority of both the houses. It also requested two legal associations to send amicus curiae to discuss the stay order on the writ.
The SC, in the show case notice, has asked the government to clarify whether this agreement invokes Article 279 (2) of the Constitution of Nepal, which deals with natural resources, its use and distribution.
Upadhyaya had filed the writ seeking a halt on the implementation of the 10,000 power trade agreement reached between Nepal and India during External Affairs Minister of India S Jaishankar’s recent visit to the Himalayan country in January.
