Advocates to present arguments on behalf of CM Thapa today

The writ filed against the formation of the Koshi Province government is being heard by a full bench of the Supreme Court even today.

A full bench of justices comprising Sapana Pradhan Malla, Dr Kumar Chudal and Nahakul Subedi will continue hearing the case today as it was not concluded yesterday.

A joint bench of justices Malla and Sushmalata Mathema on Sunday had ordered to send the case to the full bench.

Advocates on Monday presented their arguments on the writ on behalf of the petitioner.

CPN (UML) Parliamentary Party leader Hikmat Karki on August 23 filed the writ at the Supreme Court arguing that the vote of confidence taken by Chief Minister Uddhav Thapa on August 21 was constitutional.

Most of the advocates have argued that chairing the province assembly as the senor-most Member of Parliament (MP) is equivalent to that of the speaker, and maintained that the government should be formed by the largest party in line with Article 168 (3) of the Constitution.

Smail Mansur, who chaired the province assembly as the senior most member of province assembly, cast his vote in the trust vote taken by Chief Minister Thapa on August 21.

UML Parliamentary Party leader Hikmat Kumar Karki on August 23 lodged a writ petition at the Supreme Court arguing that the process of taking the vote of confidence is unconstitutional. Chief Minister Thapa, Province Chief Parshuram Khapung and Provincial Secretariat have been mentioned as defendants in the writ.

Advocates including Shambhu Thapa, Krishna Bhakta Pokharel, Surendra Bhandari, Rajendra Ghimire advocated on behalf of Karki on Monday.

Advocates today are presenting their arguments on behalf of Chief Minister Thapa.
