The High Court, Tulsipur, Butwal Bench, has ordered the release of the President of Rastriya Swatantra Party, Rabi Lamichhane.
A joint bench of Chief Judge of the High Court, Tulsipur, Basudev Acharya and Judge Tej Narayan Paudel on Thursday ordered the release of Lamichhane on a bail.
Rabi has to deposit 27 million 484 thousand rupees in bail to be released and will require permission to travel abroad, according to the court.
Lamichhane, who was in a judicial custody in connection with a cooperative fraud case, filed a petition at the High Court in Tulsipur, seeking his release, after the District Court, Rupandehi, rejected his plea even after depositing a portion of his claimed amount.
Rabi had filed a petition in accordance with Section 71 of the Criminal Procedure Code, 2017, requesting that he be allowed to defend the case while furnishing a bank guarantee for his proportionate share of the claimed amount allegedly transferred from the Supreme Savings and Credit Cooperative.
With regard to the claimed amount, the court observed that he had provided proportionate security through a bank guarantee, thereby ensuring the recovery of depositors’ funds.
“The primary priority is to ensure the protection of depositors’ and investors’ funds. Accordingly, the bank guarantee furnished by the defendant is accepted under the following conditions, and the case proceedings shall move forward,” the court order states.
The order sets out five conditions for Rabi’s release. These include acceptance of the previously imposed bail, securing the claimed amount through a bank guarantee, and providing prior notice to the court in case of foreign travel.
The court has also stipulated that he must agree to fulfill any additional liabilities that may arise in accordance with the verdict issued by the court.
